These Terms of Service ("Terms") are a binding agreement between you and [COMPANY NAME] ("Juke," "we," "us") governing your use of the Juke mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Accounts
- Minimum age. You must be at least 13 years old to use the Service — or, if you live in the European Economic Area (EEA) or the United Kingdom, at least the minimum age of digital consent in your country (up to 16 in some countries). If you are under 18 (or the age of majority where you live), you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. We may terminate any account we reasonably believe belongs to someone below the applicable minimum age.
- Account accuracy. You must provide a valid email address and keep your account information accurate. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at [SUPPORT EMAIL] if you suspect unauthorized use.
- One person per account. Accounts are personal to you and may not be sold, transferred, or shared. Where the Service allows posting on behalf of a group you belong to, you remain personally responsible for content you post.
2. The Service
Juke is a social platform organized around groups and events. Features include user profiles, group memberships and roles, a social feed with posts, likes, and comments, public and invite-only events with guest lists and RSVPs, event photo feeds, event and direct messaging, music request queues, follows, and an event map. We may add, modify, suspend, or remove features at any time without liability to you. The Service is provided free of charge; if paid features are introduced, they will be governed by additional terms presented at that time.
3. User Content
- Your content. "User Content" means anything you submit to the Service — posts, comments, messages, photos, profile and group information, event details, music requests, and anything else. You retain ownership of your User Content.
- License to us. By submitting User Content, you grant Juke a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for technical purposes such as resizing), display, and distribute that content solely to operate, improve, and promote the Service. This license ends when you delete the content or your account, except (a) where content has been shared with others who have not deleted it, (b) for backup copies retained for a limited period, and (c) where retention is required by law.
- Your responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to post it and that it does not violate any law or third-party right (including copyright, trademark, privacy, and publicity rights).
- Photos of other people. Event photo feeds and profile galleries may contain images of other attendees. Do not upload photos of identifiable people without their permission, and promptly remove a photo if the person depicted asks you to.
- No obligation to host. We may remove, restrict, or refuse to display any User Content at any time, with or without notice, for any reason or no reason, including content we believe violates these Terms.
4. Community Rules — Zero Tolerance for Objectionable Content
We have no tolerance for objectionable content or abusive users. You must not post, share, or send content that:
- is unlawful, threatening, harassing, bullying, defamatory, or hateful, or that targets anyone based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic;
- is sexually explicit, exploits or endangers minors in any way (which we will report to authorities), or depicts graphic violence;
- promotes self-harm, illegal drug sales, weapons sales, or other illegal activity;
- constitutes spam, scams, phishing, or deceptive impersonation of any person, group, or organization;
- infringes anyone's intellectual property, privacy, or publicity rights;
- contains another person's private information (addresses, phone numbers, IDs, financial information) without their consent; or
- contains malware or attempts to interfere with the Service.
You also must not:
- use the Service to organize or promote events involving illegal activity, including underage drinking or illegal drug use;
- harvest or scrape data from the Service, or access it by automated means;
- attempt to probe, circumvent, or breach the Service's security or access controls, or access data or accounts you are not authorized to access;
- misuse invite codes (e.g., selling them or using them to gain access you were not granted); or
- circumvent a block another user has applied to you, or evade an enforcement action by creating a new account.
Enforcement. We may investigate violations and take any action we deem appropriate, including removing content, restricting features, suspending or permanently terminating accounts, and reporting to law enforcement. We act on reports of objectionable content within 24 hours of receipt by removing the content and/or ejecting the responsible user where we determine a violation occurred.
Moderation decisions — users in the EEA and UK. If we remove or restrict your content or account, we will, where required by law (including the EU Digital Services Act), tell you what was removed or restricted and why, and which rule or legal ground the decision was based on. You may contest a moderation decision by contacting us at [SUPPORT EMAIL] within six months of the decision; a person (not solely an automated system) will review your complaint. This does not limit any right you have to raise the matter with a court or competent authority in your country.
5. Reporting and Blocking
The Service provides tools to report posts, photos, comments, messages, and users, and to block other users. Blocking a user prevents further interaction between you and that user within the Service. We review reports and take appropriate action as described in Section 4. To report an urgent safety issue, contact [SUPPORT EMAIL]. If you or anyone else is in immediate danger, contact local emergency services — the Service is not a means of emergency communication.
6. Events — Important Safety Disclaimer
- We are not the host. Events listed on the Service are created and run by users, not by Juke. We do not organize, sponsor, supervise, endorse, or verify any event, host, venue, or attendee. Event details (time, place, guest lists, capacity) are provided by users and may be inaccurate.
- Attend at your own risk. You attend events entirely at your own risk. To the maximum extent permitted by law, Juke is not responsible for anything that occurs at or in connection with an event, including personal injury, property damage or loss, criminal acts of hosts or attendees, or the condition of any venue.
- Hosts' responsibilities. If you host an event, you are solely responsible for complying with all applicable laws, including those governing alcohol service, minors, occupancy, permits, noise, and safety, and for the conduct of your event.
- Alcohol and drugs. The Service may not be used to promote or facilitate alcohol consumption by minors or any illegal drug activity.
- Meeting people. Exercise caution when interacting with people you meet through the Service. We do not run background checks on any user.
7. Location and Map Features
The map and place-search features use your device's location only with your permission, which you may revoke in your device settings. Event locations are user-provided and may be inaccurate. Do not rely on the Service for navigation or safety-critical purposes. Be mindful that attaching a location to an event or attending a public event may reveal your whereabouts to other users.
8. Music Requests
Music request queues let attendees suggest and upvote songs at an event. The Service does not stream, play, or distribute music. Hosts are solely responsible for having any licenses required for music played at their events.
9. Privacy
Our Privacy Policy describes what information we collect (including your email address, profile information, content you post, and — with permission — device location) and how we use it. By using the Service, you acknowledge the practices described there. Note that content you post to public feeds, public events, and groups is visible to other users, and messages are visible to their recipients.
10. Intellectual Property; Copyright Complaints
The Service, including its software, design, and branding (excluding User Content), is owned by Juke or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app on devices you own or control, solely for personal, non-commercial use in accordance with these Terms and the applicable app-store rules.
If you believe content on the Service infringes your copyright, send a notice to [SUPPORT EMAIL] including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner; and (f) your physical or electronic signature. We may remove allegedly infringing content and terminate repeat infringers' accounts.
11. Termination and Account Deletion
- By you. You may stop using the Service at any time and may delete your account from within the app's settings. Account deletion removes your profile and content from the Service as described in our Privacy Policy, subject to limited retention for legal, security, and backup purposes.
- By us. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or where required by law. We may also discontinue the Service entirely. For consumers in the EEA and UK, if we terminate for a reason other than your breach of these Terms, illegal conduct, or legal requirement, we will give you reasonable advance notice, and where required by the EU Digital Services Act we will provide a statement of reasons as described in Section 4.
- Effect. Upon termination, your license to use the app ends. Sections that by their nature should survive (including Sections 3.2, 4, 6, and 12–16) survive termination.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CONTENT WILL BE ACCURATE OR PRESERVED, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING ANY EVENT, USER, OR USER CONTENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) JUKE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO THE SERVICE, ANY EVENT, OR ANY USER CONTENT OR USER CONDUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD, OR FOR INTENT OR GROSS NEGLIGENCE WHERE SUCH LIABILITY CANNOT BE EXCLUDED.
EEA/UK consumers: nothing in Sections 12–14 affects your statutory rights, including any legal guarantee of conformity for digital content and digital services under EU or national consumer law.
14. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Juke and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or of any law or third-party right; or (d) any event you host or attend.
15. Dispute Resolution; Governing Law
- Governing law. These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. If you are a consumer habitually resident in the EEA or the UK, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
- Informal resolution first. Before filing any claim, you agree to first contact us at [SUPPORT EMAIL] and attempt in good faith to resolve the dispute informally for at least 30 days.
- Venue. Except as provided in Section 15.1 for EEA/UK consumers, any dispute not resolved informally will be brought exclusively in the state or federal courts located in [STATE], and you consent to their jurisdiction.
- Jury and class waiver. To the extent permitted by the law that applies to you, you and Juke each waive any right to a jury trial and agree that claims may be brought only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding. This waiver does not apply where prohibited by law, including for consumers in the EEA and UK.
- EU consumer bodies. If you are an EU consumer, you may also be entitled to refer a dispute to a consumer protection authority or an approved alternative dispute resolution body in your country of residence.
16. Apple App Store Terms
If you downloaded the app from Apple's App Store, the following additional terms apply:
- These Terms are between you and Juke only — not Apple. Apple is not responsible for the app or its content.
- Your license to the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Use (including any Family Sharing rules).
- Apple has no obligation to provide maintenance or support for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
- In the event of a third-party claim that the app infringes intellectual-property rights, Juke, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to the Service and These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect — for consumers in the EEA and UK, with reasonable advance notice of at least 15 days unless a shorter period is required for legal, safety, or security reasons. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may terminate the agreement at no cost by ceasing to use the Service and deleting your account before the changes take effect.
EEA/UK right of withdrawal. If you are a consumer in the EEA or UK, you have a statutory right to withdraw from a contract for digital services within 14 days of concluding it, without giving a reason. The Service is currently provided free of charge, so no refund is implicated; you may exercise withdrawal at any time by deleting your account or by emailing [SUPPORT EMAIL].
18. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Juke regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, employment, or agency relationship.
